Dec 7 2005
[...It's kind of funny how quickly, and yet how slowly news gets around. The word seems to be that Robert Byers filed a class action lawsuit over the Xbox 360 overheating problem. I'll have to do a bit of digging, but I'm pretty sure that you have to apply ]

On the 22 of November after sitting in a chair for 6 hours, I received my Xbox 360 and 30 min later, it crashed allowing no game play at all. From screen freezing to error messages and the port 2 controller not being recognized. I called the Support Center 3 times that day to find out that I would be receiving a box the next day on an overnight shipment. After multiple days of waiting, I called the support center and they told me to wait a few more days due to Thanksgiving.
I allowed a few days to pass and I called back and they told me that they got my address wrong. After they got the right address, I received the box the next day after a 10 day wait. I mailed the box on the 2nd of December and they received it on the 7th. I called the 9th to get an update on the progress of the repair, and I was told that I would receive it on the following monday or tuesday, which was the 12th and 13th. That did not happen, so I called again and talked to a supervisor, Brian, and he told me that he would email and call the repair center and it would be a 48 to 72 hour wait before he could contact me with some information on the xbox. I waited until Friday and had not received a call, so I called back and was told the same thing by a different supervisor that he would personally take care of it. Then I waited another 48 to 72 hours and I still hadn’t received a call or the xbox. Seeming like an endless cycle, I called back again to find out no information and that it would only be another 48 to 72 hour wait before they could find out anything. Once again, no call or xbox!
So on the 22 of December, a month after purchasing the 360, I still had not been able to play my console for more than 30 minutes. I still had no information on the progress of the repair or when I would be receiving it back. I had talked to numerous supervisors about the situation, and there was no progress. So a month after receiving the console, I called back once again, spoke to a supervisor, and was told that I could be called back within 10 to 15 minutes even if they did not know anything. I waited the whole day, and I never received a call from them. I waited over Christmas until monday and called them again only to find out nothing more than I had already known. So, here’s my situation: $600+ on console and accessories, numerous on of waiting on the phone (20+), no returned phone calls that I was promised, AND NO XBOX!!!!! The sad thing is, I sat at Walmart for 6 hours to be one of the first people to get an xbox, only to play it for 30 minutes, have to return it, and see that the 2nd wave on consoles in stores. Since December 7th, all I know pertaining to my xbox is that they have received it.
*I would really appreciate it if whoever reads this will pass it on to other webisites. I have had no luck trying to getting my xbox returned. I have asked supervisors if I could contact any one who is higher than them and they have lied to me multiple times about repairing my xbox. I am on the verge of contacting a lawyer and taking the situation further. So any help would be really appreciated.

I would not advise anyone to purchase an xbox 360 at its current status due to crashing. It is a unbelievable console from my 30 minute experience, well worth its money. But I advise buyers, because of my current experience, be cautious.
